Ludik Évasion Terms of Use
Version 1.1 - effective as of December 2, 2026.
Reference language notice: This English translation is provided for convenience only. In case of discrepancy, inconsistency, or interpretation difference, the French version shall prevail.
Ludik Evasion, a SAS with a share capital of 1 000 euros, registered under RCS du Puy-en-Velay sous le numéro 933 100 042, with its registered office at 751 route de Recours, 43800 Beaulieu, France (the "Publisher"), operates the Ludik Évasion application, available on the web at https://ludik-evasion-preview.lezo.app and through the mobile applications published under the Ludik Évasion brand (the "Application").
1. Purpose and scope
1.1 The Application makes it possible to discover, join and play treasure hunts and interactive trails (the "Quests"), and allows authorized organizations to operate and monitor them.
1.2 These terms of use (the "Terms") apply to any person using the Application, whether they take part in a Quest or act on behalf of an organization. They are accepted by creating an account, entering a Quest or any use of the Application. When an account is created, the Application records the acceptance of the Terms together with the version accepted and its date.
1.3 Relations between the Publisher and operator organizations are governed by the operator terms. The purchase of a paid registration for a Quest is governed by default by the Quest registration terms published in the Application or, where the organization selling that registration presents its own terms of sale before payment, by those terms.
2. Definitions
"User Content" means any content submitted by a User in the Application, in particular a team name, an avatar, an answer, a photo, a video, a sound or end-of-game feedback.
"Operator" means the professional organization that operates a Quest under license from the Publisher and, where applicable, sells its registrations.
"Organizer" means the Operator, or the Publisher where it operates a Quest itself, as well as the persons acting on their behalf.
"Participant" means any person who joins or plays a Quest, alone or as part of a team.
"User" means any person using the Application, in particular a Participant or a person acting on behalf of an organization.
3. Roles of the Publisher, Operators and LEZO
3.1 The Publisher operates the Application under its brand. It designs the Quest scenarios, presents the available Quests and provides the Application's features.
3.2 Each Quest is operated by an Organizer, which sets its dates, locations, prices and participation conditions and supervises how it runs. When a Participant buys a registration, the sales contract is concluded with the Organizer selling it.
3.3 The software solution on which the Application is built is provided to the Publisher by LEZO, which acts as the Publisher's technical service provider. LEZO is not a party to these Terms.
4. Access to the Application and accounts
4.1 Downloading the mobile application and browsing the available Quests is free of charge. Connection and equipment costs remain the User's responsibility.
4.2 A Participant may join a Quest through a QR code, an invitation link, a registration or by selecting a Quest in the Application. Depending on the flow, they may play with a session created automatically on their device, without a named account, or create an account with their email address from the mobile application.
4.3 Anyone may create a Participant account on the website or in the Application; that account gives access to no organization. Persons acting on behalf of an organization access their area by invitation; an invitation is personal, single-use and valid for seven (7) days. Organization management and operating features are reserved for adults acting on behalf of a professional.
4.4 Sign-in may be performed with an email address and password, with a code or link sent by email and, where this option is offered, with a Google account.
4.5 The User provides accurate information, does not use a third party's identity or access, and keeps their credentials, codes, invitation links and QR codes confidential. They inform the Publisher at [email protected], and where applicable the Organizer, of any compromise or unauthorized use of their access.
5. Taking part in Quests
5.1 Depending on the Quest and its settings, the Application makes it possible in particular to view steps and content, answer questions and challenges, use hints, follow progress and scores, view rankings, submit photos and media and give end-of-game feedback.
5.2 Where the Quest uses geolocation, the device's position may be used to unlock a step, validate an objective or guide the team, with the device's permission. Where the Organizer offers a trail history, the Application asks each Participant separately for their agreement; refusing does not prevent playing. Where this history has been accepted, the authorized Organizer may see, during the game, the last position transmitted in order to monitor the Quest.
5.3 A photo sent during the game is first visible to the team and to the authorized Organizer. It is shared with other Participants, in the Quest album, only if publication has been accepted and no team member objects; an objection removes the entire album from publication. A published photo may also be visible to anyone holding the public link of a ranking where the Organizer has activated that link.
5.4 The team name and avatar, progress, scores and results may be visible to the other Participants of the Quest and, where the Organizer has activated a public ranking, to anyone holding the link to that ranking.
5.5 The User follows the Organizer's instructions, the rules of the places visited, traffic rules and safety rules. The Application does not replace attention to the real environment, in particular when moving around.
5.6 The dates, locations, prices, cancellations, postponements and refunds of a registration are the responsibility of the Organizer selling it. Any request on these matters must be addressed to that Organizer.
6. Presentation and ranking of Quests
6.1 Where the Application presents the list of available Quests, they are ranked according to the following parameters, in order of importance:
- where the User has allowed access to their device's location, the distance between that location and the Quest's starting point, calculated on the device, the nearest Quests being presented first
- where no location is available, at equal distance or for Quests without a starting point, the display rank set by the Publisher when it selects the applications in which the Quest is presented, then the name of the organization operating the Quest, in alphabetical order, then the Quest's creation date
6.2 No payment makes it possible to obtain a better ranking. Quests operated by the Publisher appear in the same list as those of the Operators. The Publisher does not use the display rank to favor its own Quests over those of the Operators.
7. Minors
7.1 Autonomous use of the Application to take part in Quests is open from the age of thirteen (13). A minor under thirteen (13) may take part in a Quest only in a setting organized by an Organizer, under the Organizer's responsibility and with the authorization of their legal representatives. Organization management and operating features are reserved for adults.
7.2 Where a feature relies on consent, in particular trail history, photo publication, the collection of participant data or audience measurement, the Application asks the User to confirm that they are fifteen (15) or older, or that a holder of parental authority consents with them. This confirmation is recorded with the proof of consent.
7.3 It is the Organizer's responsibility to define the conditions under which minors take part, in particular age-appropriate information, the legal representatives' authorizations, on-site supervision and the features enabled for the Quest, in particular photos, trail history and public rankings.
7.4 On mobile, where the operating system requires it, the Application reads the age range provided by the system, using thresholds of thirteen (13), fifteen (15) and eighteen (18), in order to limit access to certain features. This information is neither stored nor transmitted to the Publisher.
8. User Content
8.1 The User retains the rights in their User Content. They warrant that they hold the rights and authorizations required to submit it, in particular the agreement of identifiable persons appearing in a photo or video.
8.2 The User grants the Publisher and the Organizer of the relevant Quest, free of charge and on a non-exclusive basis, the right to host, reproduce, technically adapt and display their User Content in the Application, worldwide, solely for the purposes of running the Quest, displaying the results, rankings and albums provided by the Quest, support and security, and for as long as it is retained in the Application.
8.3 This license does not allow the Publisher to use User Content for advertising or communication purposes outside the Application without the User's prior agreement.
8.4 The User may delete a photo of their team from the Application and report a shared photo under the conditions of article 10. Account deletion is covered in article 17.
9. Rules of conduct
The User shall in particular not:
- submit illegal content, in particular content that is insulting, defamatory, discriminatory, hateful, violent, pornographic or that infringes the privacy, image rights or intellectual property rights of others
- photograph or film people without their agreement where it is required
- cheat, manipulate scores or rankings or undermine the fair running of a Quest
- disrupt the operation of the Application, circumvent its security measures, access it by automated means or extract its data
- use the Application for commercial purposes not authorized by the Publisher
10. Reporting illegal content
10.1 Anyone may report to the Publisher content in the Application that they consider illegal or contrary to these Terms, using the reporting form available at https://ludik-evasion-preview.lezo.app/en/report. This form can be reached in particular from public ranking pages; in the mobile application, a shared photo can be reported from that photo. A report may also be sent by email to [email protected].
10.2 To allow it to be processed, the report includes, with the form guiding its author:
- a sufficiently substantiated explanation of the reasons why the content is considered illegal
- a precise indication of the location of the content, in particular the name of the Quest, the name of the team, the date and, where applicable, the address of the relevant link
- the email address of the person submitting the report, except where they are signed in to their account or where the report concerns an offense for which the law allows it not to be provided
- a statement confirming that the person submitting the report believes in good faith that the information and allegations it contains are accurate and complete
10.3 The Publisher acknowledges receipt of the report by email, examines it in a diligent, objective and non-arbitrary manner, and informs its author of its decision and of the available means of redress.
10.4 Where the Publisher becomes aware of information giving rise to a suspicion that a criminal offense involving a threat to the life or safety of one or more persons has taken place, is taking place or is likely to take place, it informs the competent authorities.
11. Moderation and decisions
11.1 The Publisher may remove or disable access to User Content, restrict its visibility, or suspend or terminate a User's access to all or part of the Application where the content or behavior is illegal or contrary to these Terms, or in the event of a risk to the safety of Users or of the Application. The measure is proportionate to the seriousness of the breach. The Organizer of a Quest may also remove a team or a Participant from its Quest.
11.2 The Publisher's moderation decisions are taken after review by a person. The Publisher does not use automated detection or decision tools to moderate content.
11.3 When it takes a restriction decision, the Publisher informs the User concerned, where their contact details are known, by providing a statement of reasons indicating the measure taken, the facts and circumstances relied on, the legal or contractual ground for the decision and the available means of redress.
11.4 After prior warning, the Publisher may suspend for a reasonable period the access of a User who frequently submits manifestly illegal content, as well as the processing of reports from a person who frequently submits manifestly unfounded reports.
12. Complaints and redress
12.1 A User affected by a moderation decision, as well as the author of a report, may challenge the decision free of charge, within six (6) months, by email to [email protected]. The complaint is examined by a person other than the one who took the initial decision, where possible, and the decision may be reversed if the complaint is well founded.
12.2 The User may also use an out-of-court dispute settlement body certified under Regulation (EU) 2022/2065 on digital services, or bring the matter before the competent courts.
12.3 When the User acts as a consumer and the dispute falls within consumer mediation, after an unsuccessful prior written complaint, they may refer the dispute free of charge to the mediator covering the professional concerned, under Articles L.611-1 et seq. of the French Consumer Code. For services provided by the Publisher, this is the mediator that actually covers the Publisher, within the scope of its agreement. For a dispute concerning a Paid Registration, this is the selling Organizer's mediator, whose contact details appear on the registration page and in the confirmation. The Publisher's agreement does not automatically cover other Operators' activities; the technical solution provider's agreement does not replace the Publisher's agreement. A free Quest does not transfer its Organizer's activity to the Publisher.
13. Point of contact
13.1 The Publisher's single point of contact, for Users as well as for the authorities of the Member States, the European Commission and the European Board for Digital Services, can be reached by email at [email protected].
13.2 Communications with this point of contact may take place in French or in English.
14. Personal data
14.1 The Publisher processes personal data to operate the Application, under the conditions described in the privacy policy available in the Application and on https://ludik-evasion-preview.lezo.app.
14.2 For data processed in connection with a Quest, in particular teams, answers, photos, positions and participation information, the Quest's Organizer is the controller and the Publisher acts on its behalf. The User may exercise their rights with the Organizer or with the Publisher, which forwards the request.
15. Intellectual property
15.1 The Application, its software, interfaces, databases, trademarks, logos and content, as well as the Quest scenarios, are the property of the Publisher, LEZO or their licensors and are protected by intellectual property law.
15.2 The User has a personal, non-exclusive and non-transferable right to use the Application, limited to use in accordance with these Terms. Any unauthorized reproduction, extraction, decompilation or reuse is prohibited, except where mandatory legal provisions apply.
16. Availability and liability
16.1 The Publisher uses reasonable means to make the Application available. Access may be interrupted, in particular for maintenance, updates, security, incidents or unavailability of a third-party service or of the network. Some features depend on the permissions granted on the device, its compatibility and network coverage.
16.2 The Publisher is not liable for how a Quest runs on site, which is the Organizer's responsibility, nor for content submitted by Users, nor for damage resulting from use of the Application contrary to these Terms or to safety instructions.
16.3 No provision of these Terms limits or excludes the Publisher's liability where such limitation or exclusion is prohibited by law, nor the rights of a consumer User under mandatory provisions.
17. Account deletion and end of use
17.1 The User may stop using the Application at any time. They may delete their account from the mobile application, from their account settings on the website or by sending a request to [email protected]. The page https://ludik-evasion-preview.lezo.app/en/account-deletion describes the procedure and the data retained after deletion.
17.2 Deleting the account erases the account data and dissociates the game history from the deleted account. That history, in particular the team's scores and rankings, may be retained in a form that no longer refers to the account where it remains necessary for other Participants, for the Quest results or as evidence of choices expressed.
17.3 In the event of a serious or repeated breach of these Terms, the Publisher may delete the User's account, under the conditions of article 11.
18. Amendments to the Terms
The Publisher may amend these Terms to reflect legal, technical or functional developments. Substantial amendments are brought to Users' attention by appropriate means within a reasonable period before they take effect, and take effect when this period expires. A User who refuses them may stop using the Application and delete their account under the conditions of article 17.
Where the User acts as a consumer, continued use of the Application does not, by itself, constitute acceptance of a substantial amendment. For other Users, continued use of the Application after the new Terms take effect constitutes acceptance of them.
19. Language
These Terms are drafted in French. A translation may be provided for information purposes. In the event of any conflict between the versions, the French version prevails.
20. Contact
For any question regarding these Terms, the User may contact the Publisher:
- by email at [email protected]
- by post at the following address: Ludik Evasion, 751 route de Recours, 43800 Beaulieu, France
Technical support requests are addressed to [email protected].
21. Governing law and jurisdiction
These Terms are governed by French law. Where the User is a consumer residing in another Member State of the European Union, they also benefit from the mandatory provisions of the law of their country of residence.
A User acting as a consumer may bring proceedings, at their choice, before any court having territorial jurisdiction under the French Code of Civil Procedure or before the court of the place where they resided when the contract was concluded or when the harmful event occurred. Where the User acts as a professional, failing amicable resolution and subject to mandatory rules, in particular those protecting consumers, any dispute is brought before the competent courts for the place of the Publisher's registered office.
